Terms of Use

This is a production draft, written to describe BabyGather’s actual product behavior as accurately as possible, for legal counsel review before broad public launch.

Operator

BabyGather (https://babygather.ae) is operated by citybusiness LLC, organized in Wyoming, United States (“BabyGather”, “we”, “us”). By creating an account or using BabyGather, you agree to these Terms of Use and our Privacy Policy.

Eligibility

You must be at least 18 years old to create a BabyGather account.

Your account

You’re responsible for keeping your login credentials confidential and for the accuracy of the information you provide us. Let us know at support@babygather.ae if you believe your account has been accessed without your permission.

The registry service

BabyGather lets you:

• Create one or more registries
• Add products from our own catalog
• Add products from other (“third-party”/“external”) retailers by pasting in a link
• Share a registry with others, including via WhatsApp, a copied link, or your device’s native share feature
• Let gift-givers mark a physical item as purchased/reserved, so other guests can see it’s covered
• Create cash-fund entries that record pledges toward a goal amount (see “Cash funds” below)

BabyGather does not currently offer its own checkout, cart, shipping, or order management — those are not part of the service today.

Third-party retailers

When you or a gift-giver follows a retailer link from BabyGather:

• The resulting transaction is between that person and the retailer, not with BabyGather.
• BabyGather is not the seller of that retailer’s merchandise.
• The retailer’s own terms of sale apply to that transaction.
• Shipping, delivery, returns, refunds, and warranties are controlled by the retailer, not BabyGather.
• Retailer prices and availability can change at any time; BabyGather does not guarantee the continued availability or accuracy of any third-party product information.

Affiliate relationships

BabyGather may earn a commission on qualifying purchases made after following certain retailer links, at no additional cost to the purchaser. Not every retailer link on BabyGather is necessarily part of an affiliate program. See our Affiliate Disclosure.

Cash funds are pledges, not payments

The current cash-fund feature lets a registry owner set a goal, and lets guests record a pledge toward it. Please read this carefully:

• BabyGather does not currently collect, hold, or transfer cash-fund money.
• A recorded pledge is not proof that payment was made, sent, or received by anyone.
• BabyGather does not act as a wallet, escrow, or payment processor of any kind.
• Don’t rely on BabyGather as a ledger of money that has actually changed hands — arrange payment directly with the people involved.

Marking an item purchased

Clicking “View offer” on a retailer link does not mark an item purchased. Marking an item as purchased or reserved is a separate, explicit action a gift-giver takes. BabyGather cannot independently verify that a purchase actually happened at the retailer — marking an item purchased is a courtesy signal to other guests, not a guarantee.

Your content

You’re responsible for the registry names, greetings, notes, and URLs you add to BabyGather. Only provide content you have the right to share, and don’t link to anything unlawful or malicious. We don’t claim ownership of the content you add — it’s yours.

Prohibited conduct

You agree not to use BabyGather to:

• Commit fraud or impersonate another person or business
• Post or link to malicious, unlawful, or harmful content
• Abuse, harass, or attempt to harm other users
• Attempt to attack, disrupt, or gain unauthorized access to the service
• Scrape, systematically extract data from, or otherwise automate abusive access to the service
• Attempt to bypass any access control, including a registry’s privacy setting

External links

Links to third-party retailers are provided for your convenience and for commerce discovery. We don’t control those sites and aren’t responsible for their content.

Intellectual property

The BabyGather name, logo, and the site/app itself belong to citybusiness LLC. Nothing here transfers any of that to you, and nothing here affects your ownership of your own content.

Changes to the service

We may add, change, or discontinue features of BabyGather at any time. We’ll try to avoid disrupting your existing registries when we do.

Disclaimers

BabyGather is provided “as is.” We don’t guarantee the service will be uninterrupted or error-free, and, as described above, we don’t guarantee anything about a third-party retailer’s pricing, stock, or service quality.

Limitation of liability

Draft for counsel review. To the extent permitted by law, citybusiness LLC’s liability arising from your use of BabyGather is limited, and we are not liable for indirect, incidental, or consequential damages, or for the acts of third-party retailers. This section is a starting point and is expected to be refined by counsel before public launch.

Governing law

Flagged for legal review — see context/LEGAL_REVIEW.md. As a starting point for counsel review, these Terms are intended to be governed by the laws of Wyoming, United States. This is a draft position, not a final determination: it does not attempt to waive any mandatory consumer-protection rights that may apply to users located in the UAE or elsewhere, and the interaction between a Wyoming governing-law clause and protections for UAE-based users needs qualified legal review before public launch.

Disputes

Flagged for legal review. These Terms do not currently include a mandatory arbitration clause or a class-action waiver. For now, disputes are intended to be handled through the courts of Wyoming, United States, subject to counsel’s review of whether that’s appropriate given our user base.
